Cancelled wind energy farm brings lawsuits from Xcel, EnXco

Xcel Energy and EnXco are suing each other in federal court over a cancelled wind farm in North Dakota, according to the Minneapolis/St. Paul Business Journal.



Xcel's Northern States Power Co. unit is asking the U.S. District Court in Minnesota to say that its decision to end the $400 million, 150 MW Merricourt Wind Project's was proper. EnXco in its lawsuit is asking the court to force Xcel to complete the contract or pay $245 million for breaking the agreement.



The lawsuits come days after EnXco refunded Xcel $100 million from the development, the article said. Xcel decided not to build the project because the U.S. Fish & Wildlife Service expressed concern that the wind turbines threatened endangered species of birds. The plant was scheduled to enter service in 2011.
