US. preliminary Chinese PV product dumping trade protection is unfair to Chinese PV companies

APV winter is filling the world, this brutal economic environment has made it so that overseas there has been a number of PV manufacturers forced to close down, the competitive relationship has locked them into a fight for their survival.
October 19, 2011, the U.S. solar equipment manufacturer SolarWorld  filed a complaint to the U.S. Department of Commerce, asked the U.S. government 49.88% -249.96% levy anti-dumping duties and countervailing duties on such exports. March 20, 2012, the U.S. Commerce Department preliminary ruling finds that Chinese exports to the U.S. crystalline silicon photovoltaic cells and modules are subsidized ,ranging from 2.9% -4.73%.

However, the data shows that as the complaining party in the United States,  the company SolarWorld has been profitable and expanding production capacity and shipments. The company's 2011 third quarter report shows that in 2011 employees in the United States increased by 11%. In contrast, the 10 listed Chinese PV companies in the United States released  third quarter data showed a profit and eight companies in the third quarter suffered losses.

U.S. Department of Commerce issued a statement on May 17, a preliminary ruling, the crystalline silicon photovoltaic cells and modules manufacturers or exporters sell their products in the United States is classified as dumping, the dumping margin is 31.14% -249.96%. U.S. Commerce Department announced preliminary anti-dumping tax rate: Suntech 31.22% 31.14%, TRW, and other Chinese enterprises, 31.18% -249.96%.

In this regard, Suntech Power Holdings Co., Ltd., Zhengrong Shi, chairman, said: "The taxes on China's PV industry is not fair". Jifan Gao, Trina Solar chairman, said: "too high, and it is not normal".

According to the U.S. program, in addition to the U.S. Department of Commerce, trade disputes need the U.S. International Trade Commission (ITC) ruling. U.S. Department of Commerce will  early in October 2012 in this regard make the final determination, the ITC will around November 19  make the final ruling. Have made an affirmative final determination, that is, finds that such products imported from China will give U.S. industry to cause substantial damage or threat, the U.S. Commerce Department will require Customs to impose anti-dumping tariffs on related products.

The United States refused to recognize China's market economy status, as China uses an unreasonable price giving them an unfair advantage, artificially inflating the margin of dumping of Chinese enterprises, highlighting the serious trend of trade protectionism in the United States.

Anti-dumping duties on the 17th show the results of a U.S. solar company stock prices are rising. First Solar rose 9%, SunPower surged 14 percent. Chinese solar manufacturers fell sharply, and Yingli plunged 12 percent, Trina Solar fell 8%, Suntech fell by 4%.

The Chinese PV companies, Yingli, Trina Solar, Suntech, Artes four PV companies will hold a press conference in Shanghai on the afternoon of the 24th of this month to oppose the ruling. In the United States, this investigations did not get all the support. It is understood that the United States have formed the organization called "cheap Solar Power Alliance, whose members include 101 companies, seven complaints enterprises led by SolarWorld issued a condemnation against Chinese unfair practices.
